How the ContractisFormed

Your contract with us will be initiated the day you contact us for your sell order. However, please note that our site is intended for use only by residents of Great Britain. You ought to have rights to all the gadgets you send to us. You must get our approval in writing before you can pass on, allocate, or eliminate a contract or any rights or duties within it.

You may terminate the contract with us any time you send us the device, provided:

  1. The contract was concluded exclusively via distance communication
  2. You are acting outside of the purposes of any business.

I) For Consumers:

If you contact us for an order, you assure that:

  • You are a resident of Great Britain
  • You are accessing our site from that country
  • You are at least 18 years of age
  • If you are under 18 years of age, you need to obtain your parent’s consent to sell your device

By sending your device to us in violation of the warranty terms, you and anyone legally responsible for you (parents/guardians) agree to release us from any blame or legal claims that might arise from that action. If you purchased this device for personal use (as a consumer), any part of this agreement that contradicts your legal consumer rights won’t apply. This agreement won’t take away the protections provided by law. In this agreement, “consumer” refers to a person who buys this device for personal reasons and not for business purposes. This definition is based on the Unfair Contract Terms Act 1977

II) For Businesses:

By placing an order, you assure us that:

  • You have permission to represent the official business
  • You are a resident of Great Britain, and you access our site from there
  • You have the legal capacity to make a binding agreement

2. For Devices

We will accept the following devices only if they match the following conditions:

I) Mobile

Excellent
  • – Flawless appearance with up to 3 very light scratches on the screen and/or body
  • – No cracks, chips, dents, or defective pixels (e.g., screen burn, dead pixels, liquid damage), and the touchscreen works
  • – Battery health above 80%
  • – Handset powers on and all parts of the device are fully working
  • – Home button, Touch ID, Face ID, and NFC all function correctly
  • – Where applicable, stylus must be included
Good
  • – Signs of more than 3 very light scratches on the screen and/or body
  • – No cracks, chips, dents or defective pixels (e.g screen burn, dead pixels, liquid damage), and the touchscreen works
  • – Battery health is a minimum of 80%
  • – Handset powers on and all parts of the device are fully working
  • – Home button, Touch ID, Face ID and NFC all function correctly
  • – Where applicable stylus must be included
Faulty

Faults may include, but are not limited to, the following:

  • – Heavy signs of scratching and/or wear on device
  • – Cracks, chips, dents or defective pixels (e.g screen burn, dead pixels, liquid damage) to screen or back
  • – Any functional defect and/or intermittent issues
  • – We cannot buy your device if it is missing components or is bent, crushed or snapped in half
  • – Dust under screen and/or on camera lens
  • – Battery health is less than 80%
  • – Handset is not fully functional
  • – Home button, Touch ID, Face ID and NFC do not function correctly
  • – Where applicable stylus is missing

II) Tablet

Excellent
  • – Flawless appearance with no visible scratches on screen and/or body
  • – Not personalised and/or engraved
  • – Screen – no defective pixels (e.g screen burn, dead pixels, liquid damage) and the touchscreen works.
  • – Tablet powers on and all parts of the device are fully working
  • – Battery health above 80%
  • – Must include stylus pen (where applicable)

Good
  • – Signs of wear on screen and/or body
  • – Not personalised and/or engraved
  • – Screen – no defective pixels (e.g screen burn, dead pixels, liquid damage) and the touchscreen works
  • – Tablet powers on and all parts of the device are fully working
  • – Battery health is a minimum of 80%
  • – Must include stylus pen (where applicable)
Faulty

Faults may include, but are not limited to, the following:

  • – Heavy signs of scratching and/or wear on device
  • – Liquid damage
  • – Any functional defect: Does not charge; freezes or is stuck in a loop; Wi-Fi; Bluetooth fault; No Service; faulty proximity; accelerometer; overheats.
  • – We cannot buy your device if it is missing components or is bent, crushed or snapped in half
  • – Battery health is less than 80%
  • – Missing Stylus Pen (where applicable)

III) Gaming consoles

Excellent
  • – Console powers on, reads discs; is fully functional including all ports and Wi-Fi; free from any physical/liquid damage or faults.
  • – Can have light signs of use.
  • – Must come with genuine, working, complete, undamaged controller.
  • – Must come with genuine, working, complete, undamaged power supply.
Good
  • – Console displays heavier signs of use e.g. Scratches; scuffs; dents.
  • – Missing; faulty or damaged controller.
  • – Missing; faulty or damaged power supply.
  • – Console is digital model that does not accept discs.
Faulty

Faults may include, but are not limited to, the following:

  • – Console does not read discs
  • – Console does not connect to Wi-Fi.
  • – Faulty HDMI Port.
  • – Missing casing; covers; screws.
  • – Console does not display an image.
  • – Console is a non UK variant.
  • – Console overheats.
  • – Signs of liquid damage

IV) Laptops

Excellent
  • – The laptop powers on and works perfectly
  • – The laptop is fully functional
  • – The laptop is free from physical damage
  • – It may have light signs of use but no significant physical damage
  • – Must include a genuine, undamaged power supply
  • – No loose hinges
  • – Laptop must be a UK model with original, unmodified software.

Good
  • – It may have scratches on the screen, a light pressure mark
  • – No loose hinges
  • – The power supply is damaged
  • – Does not overheat during use
  • – Laptop must be a UK model with original, unmodified software.
Faulty

Faults may include, but are not limited to, the following:

  • – The laptop display has heavy scratches
  • – Housing has heavy dents
  • – The laptop that has been modified is a non-UK variant
  • – Overheating issues
  • – Noisy fan
  • – One or more missing parts
  • – Swollen battery
  • – We cannot accept a laptop that has been tampered with or is missing internal components.

V) Smartwatch

Excellent
  • – Flawless appearance with no visible scratches on screen and/or body
  • – Screen – no defective pixels (e.g screen burn, dead pixels, liquid damage) and the touchscreen works.
  • – Battery holds charge
  • – Watch powers on and all parts of the device are fully working
  • – If cellular, it must connect to a network
  • – GPS works
Good
  • – Watch is functional
  • – The watch has heavy damage (more than three scratches)
  • – Battery health is at least 80%
  • – The watch has a damaged charger
  • – The watch is missing a strap.
Faulty

Faults may include, but are not limited to, the following:

  • – Damaged microphone
  • – Damaged/cracked housing
  • – Synchronization issues
  • – Battery is in poor health
  • – Signs of physical damage
  • – LCD is not original
  • – The display has very heavy scratches
  • – The watch does not charge at all
  • – We cannot buy your watch if it is barred or has been tampered with.
 

3. Data risks and precautions

This part explains what happens to your data when you send your device to us for refurbishment or recycling.We cannot guarantee the security of your data if it’s not deleted from the device. Here’s what you need to know:

  • – We are not responsible for lost or damaged data. This is inclusive of personal details, messages, photos, and any other information stored on your device

  • – We recommend deleting all personal information from your device before sending it. If your device usually works, you can use our free Mobile Data Delete Tool for step-by-step instructions

  • – If your device is broken but has a “remote wipe” function, try using that first. This will erase all data from the device remotely

  • – If your broken device can’t be wiped but has a PIN lock, that’s some protection. A PIN lock requires someone to enter a code before accessing the device. When a repair technician resets the device to fix it, the data will also be erased

  • – Completely removing data from a broken device might not be possible. If you send us a broken device, there’s a chance your data could still be accessed by someone who repairs it, including companies we sell parts to

  • – While we don’t take responsibility for your data, we try to protect it. In almost all cases, we only sell devices to companies that agree to wipe all data before using them.

In essence, it’s best to wipe off your personal information from your device before sending it in, even if it’s broken.

4. Sim card removal-imp

Important Information Before Sending Your Device:

  • – To avoid unexpected charges, please cancel any existing airtime contracts associated with the device before sending it.

  • – We are not responsible for all costs incurred before or after we receive the device, regardless of the reason.

  • – To ensure a smooth return process, please remove your SIM card before sending the device.

  • – We cannot return SIM cards accidentally sent with the device. You remain responsible for any charges incurred due to a forgotten SIM card.

5. Lost or stolen mobile phones and devices

We take preventing the sale of stolen phones very seriously. We follow a code of practice established by the UK government to ensure no lost or stolen devices are unknowingly purchased. Every phone received goes through a database check to verify it’s not reported missing.

If a phone is marked as lost or stolen, or if Fish4fones Mobile suspects any ownership issues, we’ll hold onto it for 28 days (quarantine period) and notify the seller by email. Payment is withheld until the phone clears the database check. During this time, the seller can contact the database company (CheckMEND) to prove ownership and clear the lost/stolen record. If ownership is verified within the quarantine period, the sale is processed as normal.

However, if the phone remains flagged after 28 days, we are legally obligated to hold it for law enforcement or dispose of it. The seller will not receive any payment, and by agreeing to these terms, they acknowledge this possibility.

UK law prohibits us from returning or paying for stolen phones, even if we’ve already paid the seller. The seller would then be responsible for any return costs. Furthermore, if we discover an ownership issue after payment is made, the seller agrees to fully reimburse them within three business days of a written request. 

Finally, the seller agrees to cooperate fully with fish4fones Mobile if there are any questions about phone ownership. The seller may also be contacted by law enforcement. Fish4fones Mobile can also share seller information with the police or other authorized groups (like network operators or insurance companies) to investigate or prevent crime. By agreeing to these terms, the seller consents to fish4fones Mobile sharing their information for these purposes.

6. Pricing

We offer gadgets at subsidized rates, better than our competitors

  • – Prices may change on our Website. We reserve the right to adjust prices at any time

  • – Prices include tax. All prices shown on our Website already include VAT (or other applicable tax)

  • – Order confirmation locks the price. The price you see when you confirm your order is guaranteed for 14 days after we send you a confirmation letter and a free return bag

  • – Prices may change after 14 days. If your phones arrive after 14 days from the confirmation date, the current price at that time will apply

  • – Reminder email for price guarantee. We’ll send you an email reminder during the 14-day period to help you avoid any price changes

7. Postage and packaging

  • – We offer free shipping options. Choose from various options, including free postage

  • – Safe packaging is essential. Please follow our packaging instructions carefully to ensure your phone arrives safely

  • – We can’t claim on your behalf. Since we don’t own the device until it arrives, we can’t initiate claims with shipping providers for lost items

  • – We’ll help with lost items (when possible). While we can’t directly claim on your behalf, we’ll do our best to assist you in rare cases of lost packages.

8. Payments

We accept payments in 3 ways:

  • – Cheque
  • – Bank transfer payments
  • – Gift e-card payments

i) Cheques:

We issue cheques within 24 hours of processing your order and send them by post. We reissue non-received cheques after 14 days. Cheques are valid for six months and can be reissued for up to 12 months from the original issue date. Reissuing cheques might take seven days from the date of request.

We reissue non-received cheques after 14 days. If we do receive a damaged cheque, we will apply a cancellation fee and deduct a particular amount directly from your bank account.

ii) BACS payments:

We will be issuing BACS payments once we are done processing your order, and it will take up to 48 hours for the amount to be reflected in your account. It’s the responsibility of the customer to enter the account number and sort the code correctly. Though we use software to verify these credentials, we aren’t responsible for incorrect account and sort codes. BACS payments will not be reissued under any circumstances.

We will process deliveries within two working days of receiving these payments. Due to a surge in order volume after bank holidays, Christmas, and Easter, please note that processing time could be slower.

We carry out a carrier check to look into the network of new devices. This could lead to a delay in processing by a day or two. This is a simple and secure payment option.

iii) Gift e-card payments:

  • – Perfect for Gifting: Gift e-cards are a convenient way to give the ideal present! You can use them during checkout, but be sure to apply them to the specific account details provided
  • – Final and Non-refundable: Please note that gift e-card payments are final. Once processed, we cannot recall, reissue, or swap them for another payment method. This means you cannot change your mind and switch to a different payment method after using a gift e-card
  • – Use it Before it Expires: Don’t forget to use your gift e-card before its expiry date! We are unable to reissue expired gift e-card payments.

9. Events outside of our control

We will not be responsible for any delay in performance.

If your phone has Activation Lock turned on, Fish4fones Mobile will try to help you remove it. We’ll send you an email with instructions on how to unlock it. You have seven days to respond to this email.

If you fail to respond within seven days, we’ll send your phone back to you. However, there’s a catch: fish4fones Mobile will only try to deliver it twice. In the first attempt, we’ll send it however you originally requested (standard delivery, express delivery, etc.).

If the first delivery attempt fails, we’ll contact you by phone and email to try again. This second attempt is also on them. But if the delivery fails a second time, it’s on you, the customer. You’ll need to contact fish4fones Mobile to arrange a third delivery, and you’ll have to pay for it yourself.

If you still haven’t responded after seven days of us trying to contact you, fish4fones Mobile will assume you don’t want the phone anymore. We’ll automatically process your order, but at a new, much lower price since the phone is locked. This new price for Activation Locked phones is £0.

10. Rejected offers

If you don’t accept our revised offer for your device, we’ll send it back to you within 3-5 business days. We’ll try to deliver it twice. If we can’t reach you after two tries, you’ll need to contact us to schedule a third delivery, which may incur a fee. If we don’t hear from you in a week, we’ll assume you’ve changed your mind and processed the payment based on our revised offer.

When we return your device, you will be insured; you can contact our customer service for further insurance queries.
